A Gift of Appreciated Stock and Other Securities

A gift of appreciated securities such as stock, bonds, and mutual funds can provide attractive benefits. An outright gift of long-term appreciated securities (securities held for more than a year) avoids capital gains taxes; and in most cases, you obtain a charitable income tax deduction equal to the market value of the securities. For gifts of property, your gift is fully deductible for up to 30 percent of your adjusted gross income and, like gifts of cash, may be carried forward for five additional years.

A Gift to NAMI Mass through a Tax-qualified Retirement Plan—IRAs, Keoghs, 401(k)s, 403(b)s, and Others

There are several ways in which you could contribute your retirement plan to NAMI Mass. The retirement plan is best given to charity at death and is often the best asset to give, since in many cases it can incur taxes up to more than 70 percent of its value if left to loved ones. Following are some options to consider (in doing so, you should be aware that, subject to some exceptions, at age 59 1/2, you are allowed to withdraw funds from your retirement account without an early withdrawal penalty, and at age 70 1/2, you must begin taking distributions from your plan). As an outright gift to NAMI Mass during your lifetime you could withdraw the assets and transfer them to NAMI Mass. However, when the assets are withdrawn, they will be fully taxable as ordinary income at your current tax rate. Of course, you will be eligible for an income tax deduction up to 50 percent of your adjusted gross income, and the tax benefits may be extended over five additional years if necessary. Note: If you simply transferred ownership of the retirement plan to NAMI Mass (assuming the plan allowed such a transfer), you would pay income tax in the same manner as if you withdrew the assets and transferred them to NAMI Masss.

By Designating NAMI Mass as a Beneficiary

On the beneficiary designation forms provided by your retirement plan, you could designate NAMI Mass as a beneficiary to receive all, or a stated percentage, of your retirement account upon your death, or NAMI Mass could be a contingent beneficiary in case the primary beneficiary predeceases you. If you wish to name NAMI Mass as the primary beneficiary, your spouse would need to sign a form waiving his/her rights to the proceeds. You would need to consult your own adviser and the administrator of your plan to make sure the beneficiary designation is done properly. Although there would be no present income tax deduction, because you could change your beneficiary designation at any time, this method would provide you with the opportunity to make a considerable gift to the movement, and your estate would receive an estate tax charitable deduction for the full value of the gift. In addition, at your death the retirement plan assets would normally be considered “income in respect of a decedent” (IRD) on which a nontax-exempt beneficiary, such as a child, would have to pay income tax. Because NAMI Mass is a tax-exempt organization, however, no income tax would be owed, and the full amount in your plan would pass to your beneficiary (NAMI Mass).
